1. Terms of Service

1.1 Acceptance of Terms

By accessing and using Menued ("the Service"), you accept and agree to be bound by the terms and provisions of this agreement. If you do not agree to these terms, please do not use the Service.

1.2 Use License

Permission is granted to temporarily access and use the Service for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license you may not:

  • Modify or copy the materials
  • Use the materials for any commercial purpose or for any public display
  • Attempt to decompile or reverse engineer any software contained on the Service
  • Remove any copyright or other proprietary notations from the materials
  • Transfer the materials to another person or "mirror" the materials on any other server

1.3 Account Terms

You are responsible for maintaining the security of your account and password. Menued cannot and will not be liable for any loss or damage from your failure to comply with this security obligation. You are responsible for all content posted and activity that occurs under your account.

1.4 Service Modifications

Menued reserves the right to modify or discontinue, temporarily or permanently, the Service (or any part thereof) with or without notice at any time. You agree that Menued shall not be liable to you or to any third party for any modification, suspension, or discontinuance of the Service.

1.5 Prohibited Uses

You may not use the Service:

  • For any unlawful purpose or to solicit others to perform or participate in any unlawful acts
  • To violate any international, federal, provincial, or state regulations, rules, laws, or local ordinances
  • To infringe upon or violate our intellectual property rights or the intellectual property rights of others
  • To harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate
  • To upload or transmit viruses or any other type of malicious code
  • To spam, phish, pharm, pretext, spider, crawl, or scrape

1.6 Limitation of Liability

In no event shall Menued or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the Service, even if Menued or a Menued authorized representative has been notified orally or in writing of the possibility of such damage.

2.1 Information Collection

We collect information that you provide directly to us, including:

  • Name and email address when you create an account
  • Payment information when you subscribe to our services
  • Menu content, images, and other data you upload to the Service
  • Communications between you and Menued

3. Refund Policy

3.1 Subscription Refunds

We offer a 14-day money-back guarantee for all new subscriptions. If you are not satisfied with our service within the first 14 days of your initial subscription, you may request a full refund.

3.2 Refund Request Process

To request a refund, please contact our support team at support@tx.menued.app with your account details and reason for the refund request. Refunds will be processed within 5-10 business days to the original payment method through our payment processor, Paddle.

3.3 Non-Refundable Items

The following are not eligible for refunds:

  • Subscription renewals after the initial 14-day period
  • Partial subscription periods
  • Custom development work or services
  • Accounts that have violated our Terms of Service

3.4 Cancellation

You may cancel your subscription at any time. Upon cancellation, you will continue to have access to the Service until the end of your current billing period. No refunds will be provided for the remaining period of a subscription that has been cancelled.

3.5 Exceptions

In exceptional circumstances, refunds may be granted outside of the standard 14-day window at the sole discretion of Menued management. Such requests will be evaluated on a case-by-case basis.

4. Payment Processing

4.1 Payment Processor

All payments for Menued subscriptions are processed by Paddle.com Market Limited ("Paddle"), our authorized payment reseller. Paddle is the merchant of record for all our subscription orders and handles all payment processing, billing, and customer service inquiries related to payments.

4.2 Payment Information

When you subscribe to Menued, you will be providing your payment information directly to Paddle. We do not store or have access to your complete payment card details. Paddle maintains PCI DSS compliance and uses industry-standard security measures to protect your payment information.

4.3 Billing

You authorize Paddle to charge your chosen payment method on a recurring basis according to your selected subscription plan (monthly or annually). You will be billed in advance at the beginning of each billing period. Subscription fees are non-refundable except as stated in our Refund Policy.

4.4 Price Changes

Menued reserves the right to change subscription prices at any time. We will provide you with reasonable notice of any price changes. If you do not agree to the price change, you may cancel your subscription before the new price takes effect.

4.5 Failed Payments

If a payment fails, Paddle will attempt to charge your payment method again. If payment continues to fail, your subscription may be suspended or cancelled. You are responsible for keeping your payment information up to date.

4.6 VAT and Taxes

Prices displayed may not include applicable taxes (such as VAT, GST, or sales tax). Paddle automatically calculates and collects the appropriate taxes based on your location at checkout. The final price you pay will include all applicable taxes as required by law.
